In conversation with Associate Lawyer Sarvesh Roy, Seth Associates

"With technological advancement the Cyber-crimes are increasing; every second or third person is looking forward for start-ups which is good, but it also means more IPR infringement and more commercial requirement."- Associate Lawyer Sarvesh Roy. Sir specialises in the field of cyber, commercial, IPR and anti-dumping laws.

You have been a dedicated Associate at Seth Associates, Noida since a long time now. How fruitful has your journey been so far?

Well, I joined Seth Associates on 1st March 2017 as an intern that, too to write couple of e-books, but after 10-15 days my senior assigned me another interesting work and that was to prepare a handbook for the safety of women and child which will be used by police authorities for their assistance. I researched and prepared the same which got published too. After that my interest tilted towards Cyber Law as my senior is a cyber law expert, most of the clients used to be cyber victim. When I joined this firm, I had no knowledge of drafting or Court procedure, I was just carrying bookish knowledge. Even today I get to learn something different with every new case that I handle. In my opinion I don’t think I would have gotten the same opportunity to learn like this in a comfortable environment anywhere else.

You specialised in IPR, Commercial, Cyber, and Anti-Dumping Laws. What interested you to choose these areas of law over various other available?

It is difficult to find any independent lawyer specifically working in commercial Matter, IPR, Cyber Law or Anti-Dumping. You won’t believe but most of the advocates have no idea of Anti-Dumping Rules and its procedure. Every second lawyer in our profession choose to practice in the field of civil or criminal matters because it’s kind of a set pattern or what we generally see since our childhood or college time, civil and criminal is just like banyan tree with numerous of branches. I chose these specialisations over others because of mere reason that these areas are fresh and less touched. Moreover, with the changing time, development in technology and easy access to internet, these the areas which will be full of victims in upcoming era. With technological advancement the Cyber-crimes are increasing; every second or third person is looking forward for start-ups which is good, but it also means more IPR infringement and more commercial requirement. Although these are my calculations, I might be wrong.

How were your law school days like?

To be frank I was not the bright one. From starting I was an average student. I used to study just before the exams that’s it. I never participated in moot courts and sometimes I used to regret because moot courts give you sample platform as of original Court where you can learn things which I learnt after my college internship. Rest fun and friends are part of college life.

You have had diverse internship experiences such as at R&K Associates and Agra Collectorate Bar Association. How important it is to choose internships wisely?

“Internship” is most important if you don’t want to waste 2 -3 months after your college. A good internship gives you opportunity to learn a lot at an initial stage which becomes helpful once you start your practice. Even if you just go and sit in a court room and observe how the counsels argue, how the Judges deliver their judgement, how to open fresh case before a Judge, how to behave in court room or the basic court room Procedure. These things will help you a lot once you get into practice. So, Internship is a way to gain experience and save time. Internship from good firms or under senior Advocates or Under Judge just adds extra stars in your work profile.

A word of advise for young law aspirants?

It’s better to step-in the market and then decide which way you want to head unless you have legal background, because from outside you will see all practices and fields are pretty much the same, but once you get in you will see the differences. Everyone has their own interest some want to be in criminal, others in civil or commercial but as per my opinion first taste then choose because every field have its own charm.
