Hear Representations for Waiver of Fee before Striking out Students' Names for Non-Payment of Tuition Fees

In unfortunate times of the global pandemic, human lives all around the globe are suffering a lot. Some have been stressed because of the health risks the associated with the virus, some because of losing jobs and failure in businesses, and rest majority of the population suffering from the changing patterns of living. Corona has affected India since the month of March and today there are about 13 Lakh cases in the nation. 

The worldwide statistics of the virus as per the World Health Organisation has reached 1.5 Crore. In such a scenario a lot of school, universities have been shut down and resumed classes via online platforms. As the students aren't using infrastructure and various other facilities, the demand to waive off the fees has risen. India is third most severely affected country by the virus and hence students have been demanding a waiver of tuition fees. 

Due to the financial distress it is hard for a lot of parents to deposit the fees. Earlier a single judge bench order of Punjab and Haryana permitted all schools to collect tuition fee irrespective of whether they have arranged online classes or not. In an appeal to the same was filed where a division bench of the High Court has clarified that the even though the order passed stands correct, no school can cut off the names of the students who are not able to pay the fees without giving them the right to properly represent themselves. Striking off names can only be decided after their waiver applications are properly heard and disposed by the School Management or the Regulatory Board constituted under Section 7- Punjab Regulation of Fee of Unaided Educational Institutions Act, 2016.
